These terms and conditions apply to all sales by Evolution One Ltd (“Evolution One”, “we”, “us”) of Strutt products supplied by us in the UK, including the Strutt ev¹c -Smart Everyday Vehicle and any compatible accessories, spare parts, services or related items shown on your quote, invoice, order confirmation or product page.
In these terms, “Product” or “Products” means the specific mobility chair, accessory, spare part, service or related item supplied by us under your order. Strutt is the company, brand owner and manufacturer. Evolution One Ltd sells, supplies and supports the Products in the UK as an authorised UK retailer.
By placing an order or paying a deposit, you confirm that you have read and accept these terms. Nothing in these terms affects your statutory rights as a consumer under UK law.
1. About Us
Evolution One Ltd is a company registered in England and Wales (company number 17103954). Our registered office is Depleach Hall, Wilmslow Road, Cheadle, England, SK8 1DR. Our VAT number is GB 518016806. You can reach us by email or phone using the contact details on your quote, order confirmation, invoice or website.
2. The Products
The main Strutt product we currently supply is the Strutt ev¹c -Smart Everyday Vehicle, a powered mobility chair manufactured by Strutt. We may also supply compatible accessories, spare parts, replacement parts, consumables or related services.
Specifications, dimensions, weight capacities, accessory compatibility, usage limitations, warranty coverage and any optional features are provided on your quote and in the supporting product documentation. Some features may vary slightly between production batches; any material variation will be communicated before delivery where reasonably possible.
3. Price, VAT and VAT Relief
The price of your Product is shown on your quote or invoice. Unless stated otherwise, prices are inclusive of VAT at the prevailing rate.
Delivery charges, if any, will be shown separately on your quote. Where no delivery charge is shown, delivery within mainland UK is included at no additional cost.
VAT Relief at 0% may be available only where both the customer and the goods or services qualify under HMRC rules. This usually requires the customer to be chronically sick or disabled, and the qualifying Product or service to be supplied for that customer’s own personal or domestic use.
VAT Relief does not automatically apply to every Strutt-branded product, accessory, service or order. VAT Relief is not available for company purchases, business use, demo units, stock, fleet use, resale, hire fleet or commercial operation. General-use accessories or standard parts will not qualify unless they meet the relevant HMRC conditions.
Where an accessory, spare part, repair or related service is eligible for VAT Relief, we will apply 0% VAT only to the qualifying item or service. Non-qualifying items or services will be charged with VAT at the applicable rate.
To claim VAT Relief, you must complete and return a signed VAT Relief Declaration before we issue your final invoice. The declaration does not automatically justify zero-rating; as the supplier, we must be satisfied that the customer, Product and use all qualify. We are required by HMRC to retain a copy of the declaration and related records for tax purposes.
We reserve the right to decline VAT Relief or issue a VAT-corrected invoice where the conditions for zero-rating are not met, cannot be evidenced, or cease to apply.
We reserve the right to update our prices, but the price quoted to you will be honoured for the validity period stated on your quote, typically 30 days.
4. Payment Terms
Your order may be structured in two stages:
Stage 1 – a reservation deposit, where required, secures your order and reserves your delivery slot. Unless stated otherwise on your quote, the standard reservation deposit for a Strutt ev¹c -Smart Everyday Vehicle is £99. The deposit is non-refundable except where required by law, including where you exercise a statutory cancellation right within the applicable cancellation period.
Stage 2 – the balance of the purchase price is payable in full before delivery. We will issue the balance invoice once your delivery is scheduled. No Product will be dispatched or delivered until the balance has cleared into our account.
Accessories or smaller items may require payment in full at the point of order rather than a reservation deposit.
We accept payment by bank transfer, debit card, credit card, and any other payment methods shown on your invoice or secure online checkout. Bank account details and payment links are provided on each invoice.
5. Delivery
We arrange delivery of your Products within mainland UK. Depending on the order and the delivery location, your Products will be delivered either by Evolution One directly or by a third-party courier such as FedEx or another reputable carrier. We will confirm the delivery method when we schedule your delivery.
Where delivery is made by a courier, the Product will be delivered to the address you provided. The courier may deliver to your door but does not typically unpack or position a Strutt ev¹c -Smart Everyday Vehicle inside your home. You may wish to arrange assistance for moving and unpacking on the day.
Where delivery is made by Evolution One directly, we will agree the delivery details with you in advance. Installation and setup are not included as standard. We may, as a courtesy and where time allows, help with positioning or basic setup on the day, but this is not guaranteed and should not be relied upon unless expressly stated on your quote.
Delivery timing depends on stock availability. Where the Product is in stock, we aim to offer next-day delivery following cleared balance payment, subject to delivery scheduling and your availability. Where the Product is out of stock, delivery will take place once new stock arrives; we will give you an estimated timeframe and keep you updated on progress. We will always agree a specific delivery date with you in advance.
If we are unable to meet an agreed delivery date due to circumstances beyond our reasonable control, we will contact you promptly to arrange an alternative.
It is your responsibility to ensure safe and reasonable access to the delivery address, including suitable parking arrangements and clear access routes. If access is not possible on the agreed delivery day, we may charge a reasonable re-delivery fee where permitted by law.
6. Your Right to Cancel (UK Consumer Contracts Regulations 2013)
If you bought your Product without meeting us in person – for example, over the phone, by email, or via our website – you have a statutory right to cancel your order within 14 days from the day after delivery, without giving a reason.
To cancel, please notify us in writing (email is acceptable) within the 14-day cancellation period. For a Strutt ev¹c -Smart Everyday Vehicle, we will arrange collection from your address at no cost to you, provided the Product is in its original condition and any setup has not made it impractical to remove. For accessories or smaller items, we may provide return instructions or a prepaid return label.
Once we have inspected the returned Product, we will refund the full purchase price including any deposit paid, within 14 days of receiving the goods back, or earlier where required by law.
After this 14-day cancellation window has expired, the reservation deposit is non-refundable. Any balance paid is also non-refundable unless the Product is faulty, not as described, or otherwise fails to meet the quality standards required by the Consumer Rights Act 2015.
This cancellation right does not affect your other statutory rights, including in respect of faulty or misdescribed goods.
7. Inspection on Delivery and DOA Reporting
Please inspect the Product as soon as possible after delivery. If it arrives damaged, has missing parts, has visible defects, or has an immediate functional issue, please report this to us in writing as soon as possible and preferably within 48 hours of delivery, with photographs and/or video evidence where possible.
This 48-hour reporting period helps us assess whether the matter is a Dead on Arrival (“DOA”) issue, transit damage, missing-part issue or warranty matter. Failure to report within 48 hours will not remove your statutory rights, but it may affect our ability to verify transit damage or raise a claim with the courier or manufacturer.
Where delivery is made by a third-party courier, please also note any visible damage to the packaging on the courier’s delivery receipt at the time of delivery, or refuse the delivery if damage is severe. Please retain the original packaging where possible for inspection or return transit.
We will arrange repair, replacement, refund, spare-part supply or other appropriate remedy in line with the Consumer Rights Act 2015 and your other statutory rights.
8. Warranty and Manufacturer After-Sales Support
Your statutory rights against Evolution One as the seller are separate from, and are not limited by, any manufacturer warranty, manufacturer after-sales policy, repair process or guarantee.
The Strutt ev¹c -Smart Everyday Vehicle is also subject to Strutt’s manufacturer after-sales and warranty policy. Where manufacturer warranty support, technical diagnosis, repair, replacement parts, inspection, software-related assessment or safety-related after-sales support is required, Evolution One will act as your UK point of contact and coordinate the matter with Strutt or an authorised service partner where appropriate.
The following is a customer-facing summary only. Full warranty coverage depends on Strutt’s manufacturer warranty terms supplied with the Product or made available by Strutt, and may vary by component, usage, condition and the cause of the issue.
Product area | General manufacturer warranty position | Important notes |
Main structural frame | Up to 60 months for structural manufacturing defects. | Excludes impact damage, overloading, drops, corrosion, surface scratches, water damage and other non-manufacturing causes. |
Suspension, powertrain, battery, charger, screen, joystick, sensors, LiDAR, camera, lighting, wiring and related electronic modules | Generally up to 24 months for manufacturing defects. | Coverage may be refused or limited where damage is caused by misuse, external force, water damage, non-original chargers, environmental factors, unauthorised modification, poor maintenance or normal ageing. |
Wear-and-tear items, cosmetic items, wheels/tyres, guards, covers, toolkit, seatbelt, anti-tip wheels, seat cushions, backrest cushions, upholstery and similar high-wear or consumable parts | Usually DOA-only unless confirmed otherwise in the relevant product documentation. | These items may not carry a standard manufacturer warranty. They may be eligible only for defects or transit damage identified shortly after delivery. |
Accessories, spare parts, replacement parts and consumables | May have separate terms depending on the item supplied. | The applicable position will be shown in the product documentation, product page, quote or order confirmation where relevant. |
8.1 Warranty and after-sales evidence
For warranty, repair or after-sales support, we may ask for proof of purchase, order details, the Product serial number, photographs, videos, diagnostic information, product condition, usage history, mileage, power-on time, service history and a description of the issue. Warranty support may be refused or limited where the serial number has been removed, altered, damaged or cannot be verified.
8.2 Warranty exclusions and chargeable repairs
Manufacturer warranty and after-sales support may not apply where the issue is caused by misuse, accident, collision, overloading, water damage, corrosion, unsuitable storage, failure to follow the user manual, improper maintenance, normal wear and tear, cosmetic deterioration, unauthorised repair, unauthorised modification, disassembly, use of unsuitable third-party accessories, non-original chargers, environmental factors, commercial or rental use unless agreed in writing, or any change affecting safety-critical or core systems.
If an issue is outside warranty, outside statutory rights, or caused by non-covered use or damage, inspection, labour, parts, collection, delivery and repair costs may be chargeable. Where reasonably possible, we will provide an estimate or obtain your approval before carrying out chargeable work.
9. Modifications, Third-Party Accessories and Safety-Critical Systems
Authorised modifications that fall within Strutt’s permitted scope may not invalidate the manufacturer warranty for original Strutt components. However, any damage directly or indirectly caused by an authorised or unauthorised modification may be excluded from warranty support.
Unauthorised modifications may invalidate manufacturer warranty and after-sales support. This includes, but is not limited to, disassembly, alteration or repair of the frame, chassis, load-bearing structure, motor, battery, controller, braking, steering, suspension, wiring, PCBA/control modules, sensors, camera, LiDAR, evSense or other assisted-driving or safety-related systems.
Use of third-party accessories, attachments, chargers, parts or software that do not meet Strutt’s specifications, interfere with safety systems, compromise stability or performance, obstruct sensors or affect legal compliance may also invalidate warranty or after-sales support.
10. Accessories, Spare Parts, Consumables and Hygiene-Related Items
Standalone accessories, spare parts, replacement parts, consumables, opened or used accessories, and hygiene-related items may have different return, refund and warranty conditions from the main Product. Any specific condition will be confirmed on the relevant quote, invoice, product page, order confirmation or product documentation.
This does not affect your statutory rights in respect of faulty, damaged, misdescribed or non-conforming goods.
11. Our Liability to You
As the seller, we are responsible for the Products meeting the requirements of the Consumer Rights Act 2015 – namely that they are of satisfactory quality, fit for purpose, and as described.
We will not be liable for any loss or damage that was not reasonably foreseeable at the time you placed your order, or for losses caused by events beyond our reasonable control.
Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded under UK law.
Your statutory rights as a consumer remain unaffected by these terms.
12. Data Protection
We collect and process your personal data in accordance with UK GDPR and the Data Protection Act 2018. We use your information only to fulfil your order, provide aftercare and warranty services, assess VAT Relief claims where applicable, coordinate technical support, repairs and replacement parts, and, where you have agreed, keep you informed about products and services that may interest you.
We do not share your data with third parties except where necessary to deliver your Products, provide aftercare or warranty support, work with Strutt or authorised service partners, process payments, meet legal or tax obligations, or where otherwise required by law. Our full Privacy Policy is available on our website.
13. Complaints
We aim to provide an excellent experience for every customer. If something goes wrong, please contact us as soon as possible and we will do everything reasonable to put it right. If we cannot resolve a complaint to your satisfaction, you may be entitled to refer the matter to an alternative dispute resolution provider or to the Citizens Advice consumer service.
14. Governing Law and Jurisdiction
These terms and any disputes arising from them are governed by the law of England and Wales. The courts of England and Wales have non-exclusive jurisdiction to resolve any disputes.
Version 1.2 – effective May 2026. We may update these terms from time to time. The version in force when you place your order applies to your purchase.
